Journalist shield law may not halt iPhone probe

"Under a California law dating back to 1872, any person who finds lost property and knows who the owner is likely to be--but 'appropriates such property to his own use'--is guilty of theft. There are no exceptions for journalists. In addition, a second state law says any person who knowingly receives property that has been obtained illegally can be imprisoned for up to one year."

This is the crux of the issue. I'm not sure the phone was actually "lost" either. It may have been lifted. When the identity of the "seller" comes out (police investigation, not from Gizmodo), it will be interesting to the history or background of that person.

No matter what else was done wrong, I do think that bashing in the door in the middle of the night was a bit of overkill. They could have knocked. It is not like the bloggers at Gizmodo are armed and dangerous.

If the charges are true and the receiver of the property is convicted, I think some serious community service time and probation, rather than jail, is warranted in this case.

Thoughts on Flash

The man from Apple himself, Steve Jobs, lays out why no flash will be coming to the iPhone or the iPad.

Considering how many security updates I have to do in a year and how often it crashes, I'd love to see Adobe Flash go. I didn't like it when it was Macromedia Flash. Of course, the first widespread use of it on the Web was for seemingly long loading and boring "splash screens".

Apple, with its large market share of mobile devices may just be able to force the Flash issue. Anyway, "Flash Wars" is sure fun to follow.

1) Cars that run on air have been a subject of interest to me since I saw a video on Youtube quite a while ago. I was very interested to see a man in Australia who was powering a fork lift in his warehouse with compressed air. I was struck by the fact the engine needed no oil or lubricant of any kind of due to air pressure filling in any and all gaps between moving parts thus zero friction, meaning the engine should last just about forever. 2) This is something I have seen mentioned several times lately on the net in different venues. Seems NASA is currently searching for what they are calling the Death Star. 3) It would appear there is some rumbling going on with the theory of evolution. I’m not talking about the religious debate, this is pure science. Actually the research is pointing to a challenge in the area of natural selection being the only driving mechanism of evolution. The article is about the new field of epigenetics, and discoveries dealing with environmental information being transferred through the epigenome which is part of DNA causing changes in the offspring. 4) Time for something a little edgy, over the years I have heard stories about raining fish, frogs, and the like, well it may have happened again in Australia raining fish, in the desert yet. The usual explanation for this phenomenon is a tornado, or water spout in a nearby lake or ocean, they say they eliminated that possibility. The other oddity is the fish were still alive, if they were caught in a massive updraft of some kind at seventy thousand feet they should have been frozen, or died due to lack of pressure. http://www.ntnews.com.

1) My green link for the week was sent to me by Wills, I thank you. Sometimes I look at these ideas and can only think wow!! The concept is great (I suppose that’s why they call them concept cars), but they all seem to run into that special environment restriction. If you were building a city from scratch with lots of design control it might work very well, in New York City no. Although, it would increase the parking spaces by a factor of ten, and you could have a lot more cabs and they should be cheaper to run, but making sense would never be enough cause to change anything. It is a great idea and I was impressed by the Segway - GM collaboration seems like there is a lot of potential in a union like that. A link to a story about electric motorcycles in California being touted by Arnie, they are even offering a rebate. According to the story the cost of operation is about one cent per mile, on average terrain, and speeds. The article is interesting especially about the origin of the motor, this article is about the zero-X my impression is they are same bike, with different equipment. 3) This is an article about some new tricks they are working on in genetics, referring to it as Genetic Code 2.0 kind of says it all. They are talking a total rewrite using phrases like synthetic biology, synthetic organisms, almost sounds like a cross between the Island of Dr. Moreau – and a robotics team at MIT. It has the look of a beginning, but I am not sure I want to know the ending. 4) When I saw this I was drawn in because of the neural computer talk noticed in my initial scan. The idea of creating an artificial intelligence has long been one of those fields that arouse my curiosity. The articles early reference to finding “electronics long lost missing link” did not hurt either. Google changes its name to Topeka

In response to the city of Topeka Kansas changing its name to Google Kansas, Google Inc has announced that as of 1am Central Time on April 1, 2010, the new name of the company will be Topeka Inc, as a way to honor the people of the former Topeka Kansas for changing their name to Google.

Topeka Inc has said that this honor has no bearing on the decision as to which municipalities will participate in the new high speed broadband project, of which Google Kansas has applied.

Shop Lost $200,000 from Online Banking Scam - SPAMfighter

In February 2010, cybercriminals stole $200,000 from an auto body shop in Ohio (USA), Clarke Collision Center, in a brazen robbery done online. Hackers used malware for unauthentic access of bank account.

Security experts said that small business assumes great responsibility when banking online as banks are not lawfully obliged to compensate losses suffered because of the fake activity. Therefore, business should become more careful in the matters related to IT and should regularly update the antivirus solutions and operating systems.

This is getting worst all over the place, the bad guys are not just getting into people's home computers and banks, but Small business are loosing thousands of dollars, and they don't even know. 1) With the Chevy Volt about to make its début toward the end of the year I thought a good review page might be in order. Why has it taken so long for us to get here, I suppose that is a question better answered another time? Malware is getting worse, here is an article on how it is pretending to be an update to other programs you are running like Adobe Reader. I says it's will update the software and over writes it with malware.

This is a handy tool to have around if you do any repair work on a PC. it's easy to use (If your PC will boot to a USB drive)

I just set this up on a 1GB USB stick and my Mini boots to it, I had to play a little to get the wireless NIC to work, but it does a good job!

Effective immediately, Windows XP Mode no longer requires hardware virtualization technology, Microsoft officials said today. XP Mode is a feature of Windows 7 Professional or higher that allows companies to run XP applications that are incompatible with Windows 7 in a virtual environment.
This is great news for those that wanted to run XP on their Windows 7 computer.

The FCC is asking the nation’s broadband and smartphone users to use their broadband testing tools to help the feds and consumers know what speeds are actually available, not just promised by the nations’ telecoms.

I'm all for this test! I know when I lived in Big Lake, (Alaska) I was told we get 8MB downloads speeds, and I never got over 5 down when I ran a test.

I also think that you can't use a test your ISP supplies, because it might be controlled. ;)

NASA Extends the Internet Out Into Space

Astronauts aboard the International Space Station received a special software upgrade this week - personal access to the Internet and the World Wide Web via the ultimate wireless connection. Expedition 22 Flight Engineer T.J. Creamer made first use of the new system Friday, when he posted the first unassisted update to his Twitter account, @Astro_TJ, from the space station. Previous tweets from space had to be e-mailed to the ground where support personnel posted them to the astronaut's Twitter. (source: nasa.gov)

Paul Thurrott's SuperSite for Windows: They Don't Call Them "Essentials" For Nothing

Windows 7 is an impressive and refined OS with fun and productive new features. (In fact, I award it a rare 5-out-of-5 stars in my own review.) But there are some important pieces missing. And while we might debate Microsoft's rationale for not including these solutions in Windows, the truth is, they're easy enough to find and install separately. Best of all, they're free.

Some of these are very useful, I use most of them. (I use Pidgin IM for Messenger.) However the rest are very cool.

Microsoft Security Essentials is now my Anti-Virus of choice. It's free and works just as well as any you can pay for. There are version for Windows XP and both 32 bit and 64 bit Windows 7 & Vista.

MagicJack dials wrong number in legal attack on Boing Boing Boing Boing

Gadget maker MagicJack recently lost a defamation lawsuit that it filed against Boing Boing. The judge dismissed its case and ordered it to pay us more than $50,000 in legal costs.
I have said on the show before I never could get my MagicJack working and I tried it on 3 computers here to no avail. When I called support I got no joy out of them and when asked to have my MagicJack replaced I was ignored by 2 support people. I gave up and through it out.

DailyTech - Broadband Providers Complain as March 17 FCC Broadband Plan Unveiling Nears

Reuters reports that the FCC's national broadband plan is set to be unveiled on March 17 to Congress. The plan hopes to bring affordable and fast broadband internet access to the 90 million Americans who lack service today.
Last week, the FCC announced that it is aiming for nationwide broadband speeds of 100Mbps

That would be nice, however the ISP's are saying they can't get those speeds in the next 10 years. MY question to them is WHY NOT?

4) I worked with para-transit for several years, driving people with various types of disability around Las Vegas, I suppose that is why I am attracted to advancements that help solve issues in those communities. 1) My green link for the week has to do with the clean water situation worldwide, and is currently being considered for use in Haiti. This is a system called a bio-reactor it uses bacteria to clean putrid water in about 24 hour. The green aspect of this revolves around water delivery, as an example the army is currently sending two of these to Afghanistan, they say that they can save a lot of gasoline currently used to deliver water for operations there. They are requesting the company producing them to send their prototype to Haiti to help with the recovery. http://www.wired.com
2) This is one of those technological advancements that I remember seeing in many sci-fi movies, reading about in several books. The author always has to come up with a way for all the different species of aliens to talk to our hero. Somehow I never thought I would see the universal translator in my life time, but then forgot about Google. The Google techs are working hard on the problem, and they say in a couple of years they will introduce the translator phone. You speak English in to your phone it is translated and comes out as verbal Spanish at the other end, and reverses the process back to you. 4) Today is the twentieth anniversary of a famous photograph; this is one of those things that make you think about just how small our life footprint is in the overall scheme of the universe.
